IMPLEMENTATION OF LEGAL CERTAINTY THEORY ON PERPETRATORS OF ONLINE GAMBLING PROMOTION CRIMES
Abstract
Online gambling, in line with technological advancements and the increasing accessibility of the
internet, has raised various challenges in law enforcement. This article discusses the
implementation of legal certainty theory in the context of online gambling crimes, with a focus on
issues related to proving and enforcing the law against offenders, both individuals and legal
entities. The research method used is normative juridical, analyzing relevant legislation and
literature, as well as real case studies in Indonesia. The research results show difficulties in
applying the theory of legal certainty, both in identifying offenders and in imposing appropriate
sanctions. This article also highlights the need for regulatory reform and a more adaptive legal
approach to address the challenges faced.
